Definitions: Buyer means person or business purchasing the cat. Seller means Colorado Pixies Cattery owned jointly by Rick and Marilyn Trenk. Cat means an adult cat or a kitten. Neuter means to castrate or spay the cat.
The purpose of this contract is to protect the Buyer and the Seller while binding them together in a sale agreement of the cat described below. Requirements of the sale will be pointed out below and should be read carefully before any signing. Any legal action taken against the Seller and this contract must be brought before a Court in McIntosh County, State of Oklahoma.

The Seller and the Buyer have agreed to enter into a sales contract for the sale of a Registered Pixiebob Cat for the amount of $____________USD. Deposit amount paid: $____________USD.

Payment is accepted by seller in the form of__________________________________________.

The Buyer will pay a deposit for Pets, Breeders and Show quality Cats, which is NON REFUNDABLE.
The balance owed on the agreed sale price, plus any additional expenses related to shipping, handling, transporting, flight, crate, vet bill, health certificate or etc. must be paid before delivery/shipping and is required to be paid to the seller in full, not less than 14 days before promised delivery/shipping date.
Buyer will be notified by seller before delivery/shipping date as to the amount of additional payment owed (if any).

Upon paying the balance of all monies owed on this sales contract, the Buyer becomes the owner of the said Cat listed and described above.
If the Buyer refuses to send the full amount owed on the purchase price plus added shipping and related costs or abandons the purchase of the Cat prior to shipping, the Buyer is NOT entitled to any CASH REFUND and all deposit money shall be forfeited.

If the Cat has been shipped and the Buyer abandons the Cat at the airport, the Buyer will be charged with all expenses incurred for the Cat to be returned to the Seller and the Buyer hereby agrees to pay to the seller all costs and fees related to sending the cat back to the seller.
If the above the Cat is sold as a PET, and the seller has not previously had the Cat neutered, the Cat will be neutered by the Buyer by four (4) months of age. Proof of neutering in the form of a letter from the Buyers Vet must be supplied to the Seller in a timely manner. Until that proof is provided, the Seller will retain the registration papers. If the the Cat is found not to be neutered, the Seller has full rights to collect all of the offspring and/or procedes from the sale of all offspring of the above Cat and the Cat. In this instance, replacement to any persons buying the offspring from the above Cat will be the sole responsibility of the Buyer. Registration papers will be provided by the Seller in a timely manner upon notification the Buyer has neutered the Cat with the papers being marked NOT FOR BREEDING OR SHOW so that TICA can uphold and verify the neutering of the said Cat. It is the Buyers responsibility to notify the Seller when the buyer has obtained neutering papers via USPS mail.

BREEDING, SHOWING , REPLACEMENT & DELIVERY AGREEMENT
No ColoradoPixie Pixiebob will be used in any other breed and the offspring of the registered Cat will be registered only as a Pixiebobs. If any offspring of the Cat are found to be used in any other breeding program, the Seller may collect the said Cat and all the offspring or the sales from the said Cat and/or the offspring.

The Cat cannot be shown in Household Pet Category if registered as a Pixiebob.

In selling the above Cat, the Seller guarantees it against FEL./ FELV. and birth defects not seen at the time of sale. If found, the Buyer will provide a written statement from his/her vet as to the birth defect with a copy sent to the Seller's Vet and upon agreement of test results by the Buyer's vet, A Cat of equal value will be furnished in a timely manner , with the shipping provided by the Buyer for such replacement. NO CASH REFUNDS.

The shipping or delivery of the sold Cat will be at the agreed age, time frame and in taking other things into account (weather ETC) so that the Cat will be shipped or delivered safely.The final agreement as to the readiness of the Cat to be shipped or delivered will be upon the release of the Cat by the Seller's vet after being examined by the said vet.
The Buyer will be notified of a flight plan if shipped, getting the Cat closest to the Buyer making it as convenient as possible. However, any changes made by the Airline will be left up to the Airline and the Buyer agrees to pickup the said Cat at the closest airport agreed upon by the Airline/Buyer/Seller. If the Airline makes a change due to any emergency the Buyer must pickup the said Cat and not abandon it. If for any reason the Buyer fails to pickup the Cat and if the Cat is returned to the Seller, the Buyer can agree to another choice of shipping dates AFTER the Cat has been returned to Seller's residence to be re-examined by Seller's Vet and evaluated for distress or other medical conditions. (with a possible additional expence in the form of additional medical costs)
This can be a period of up to 10 days or more depending on the release by Seller's Vet.
Buyer agrees to pay for all added expenses related to buyer failure to pickup Cat when airline delivers Cat at designated regional airport.

Any special tests the Buyer may request can be done with notification 14 days in advance and at the expense of the Buyer prior to shipping and the Buyer will receive a copy of those test results.

Upon arrival, the Buyer agrees to keep the Cat separate or isolated from all other pets and to take the said Cat to their Vet within 72 hours (not including holidays or weekends) so that the Cat can be examined by the Buyer's Vet. Within the above time frame, the Seller's Vet will examine the said Cat to declare the health and medical gaurantee has been met. The only exception will be if the Buyer's Vet finds a birth defect that is not known at the time of sale and found during the first year after delivery of the Cat. The Buyer's Vet will provide a letter and all tests proving this birth defect with a copy for the Seller's Vet. Upon agreement with Seller's Vet, the Cat will be replaced. NO CASH REFUNDS.

Since it is hard to control the care, feeding and socialization of the said Cat after the Buyer takes full possession, the Seller limits the time frame for the Buyer's Vet to examine the said Cat to the above time frame and only if all the above has been followed by the Buyer. The Seller cannot guarantee the Cat after it has socialized with other pets or has become a member of the household for over 7 days (excluding holidays and weekends).

Before delivery/shipping , when taking the Cat to the Seller's Vet, the vet must do whatever tests necessary to be able to state the Cat is healthy and free of FEL. and FELV. or any other disease that tests can identify. The Cat will have been wormed, vaccinated up-to-date and receive some type of parasite control as deemed necessary buy the Seller's Vet. All this information, as well as diet will be supplied to the Buyer and the Buyer will be responsible for supplying it to His/Her Vet. Only those chemicals approved by the Seller can be used within the guarantee. Flea control should be limited to such products as Frontline (application or spray), Frontline Plus, or Revolution and used ONLY according to the directions. To use it otherwise risks the safety of the Cat. The Seller will be available to the Buyer for questions especially within the first 7-10 days via phone, or email. Diet and care of the Cat MUST BE FOLLOWED in order for terms of the sellers guarantee to be in effect.

It is the responsibility of the Buyer to follow the Seller's directions on the care and feeding of the said Cat. It is normal for the Cat to show some amount of normal stress due to the flight and relocation. The Cat should be placed in a quiet room considered to be free of any dangers of falling objects or where it might become lodged under furniture ETC. The Cat will be allowed a reasonable amount of time to adjust to a new home in a quiet environment with access to ONE ADULT FAMILY MEMBER AT A TIME until it can be examined by the Buyer's Vet. and it becomes adjusted to the new Owner.

A diet of low fat, high protein dry food is a preferred choice with some supplementing of canned foods or meat. Dry Foods suggested are a mix of some of the following; Purina, Maximum Nutrition, Nutro Max, Iams, Science Diet, ProPlan and or any high protien dry food. This is to be fed free to feed as the Cat desires. A treat of canned foods of the above brands or small portions of low fat meat can be given to the Cat. Upon any signs of negative digestion such as loose stools or vomiting, the Buyer will notify His/Her Vet immediately AND the Seller and follow the advice of both.

It is NOT recommended that Cat be allowed outside without supervision!!!

Literature states that the FEL./FELV. vaccine is to be used with care with the Pixiebob breed. And if used, ONLY THE KILLED VIRUS is recommended. It has been found in some breeds of cats and some lines of Pixiebobs that there is a high occurrence of cancer when using this vaccine. Therefore, it is up to the descretion of the Buyer's Vet as to the use of this vaccine and to the type and brand. The Seller does not guarantee against any type of cancer associated with the use of such a vaccine, or ANYTIME AFTER this type of vaccine has ever been administered to the said Cat. It is up to the Buyer to educate His/Her self on the laws of their state regarding the use of vaccines such as above as well as Rabies. The Cat will be updated on all vaccines allowed when arriving. A copy of the health record will be supplied to the Buyer.

The Cat may not be euthanized without notifying the Seller. The Seller has the choice to make alternative suggestions of treatment. However, if the Cat must be euthanized or dies of any causes, the Buyer must do a necropsy on the said Cat to determine the cause of death. If the cause of death is associated with a birth defect and/or FEL./FELV. the Cat may be replaced IF the Buyer's Vet sends a letter of explanation, results of all tests and the necropsy, explaning how the death is associated to the Seller and both the Buyer's Vet and the Seller's Vet agree the cause of death is associated to the Seller. If any of the above is not provided, possible replacement of the Said Cat may be null and void. If agreed, a Cat of equal value can be provided in a timely manner (the Buyer may have to wait until the Seller has appropriate litter). NO CASH REFUNDS.

Under no circumstances will the said Cat be sold or leased or given to a pet store, research lab, animal shelter or similar facility! If the situation arises where the Buyer cannot keep the said Cat, the Buyer must give the Seller first choice to purchase the Cat at no more than the cost paid or an agreed upon value of the Cat if other than a pet. If the Seller does not purchase the Cat, the Buyer must provide the Cat with a suitable home and cannot release the Cat, abandon it or place it in a shelter or pet shop.  Nor will it EVER BE DECLAWED or the said Contract will be considered breached.

In signing the said contract, both parties are stating that they have read the contract thoroughly, agree with it's terms and finds them legal and binding. Any breach of this Contract by either party must be taken before the Court in McIntosh County, Oklahoma USA. or the Contract will be found to be null and void. In the event the Buyer shall violate any of the above stipulations, the Buyer here by agrees to paying all litigation costs as well as all personal transportation/food/lodging costs if the Seller prevails in a Court of Law.
